Terms of Service

Welcome to MoveMore! These Terms of Service ("Terms") govern your access to and use of the MoveMore mobile application, website, and related services (collectively, the "Services"), provided by MoveMore Inc. ("MoveMore," "we," "us," or "our").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Health and Safety Disclaimer

The MoveMore Services provide fitness information and are designed for educational and entertainment purposes only. The Services do not constitute medical advice. You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs. Do not use the Services if your physician advises against it. If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately. MoveMore is not responsible for any injuries or health problems you may experience as a result of using our Services.

2. Eligibility

To create an account and use the Services, you must be at least 18 years of age and the age of legal majority in your province, territory, or state of residence.

Geographic Availability:

Canada: The Services are available to legal residents of Canada, excluding the province of Quebec.
United States: The Services are available to legal residents of the 50 United States and the District of Columbia.

3. User Accounts

You are responsible for safeguarding your account and for all activities that occur under it. You agree to:

Provide accurate and complete information when creating your account.
Keep your account password confidential.
Not share your account with any other person.

MoveMore reserves the right to deactivate any account that has been inactive for a period of two (2) years or more. Upon deactivation, all accumulated Points will be forfeited.

4. Rewards Program

The Services allow you to earn points ("Points") by completing exercise challenges. These Points can be redeemed for rewards ("Rewards").

No Cash Value: Points have no cash value, are not redeemable for cash, and cannot be sold, traded, or transferred to another user.
Rewards: Rewards may include coupons, entries into giveaways for prizes like gift cards, or other items as determined by MoveMore. The availability of specific Rewards is not guaranteed.
Winnings Cap: To comply with tax and regulatory requirements, the total cumulative value of prizes a single user may win is strictly limited to $500.00 USD (or CAD equivalent) per calendar year. Any winnings exceeding this amount will be forfeited.
Geographic Restrictions: Giveaways are open only to legal residents of Canada (excluding Quebec) and the United States who have reached the age of majority. Local Rewards are available only in designated geographic areas (initially Windsor, Ontario) and are subject to expansion at our discretion.
Third-Party Rewards: Many Rewards are provided by third-party merchants. MoveMore is not responsible for the redemption, quality, or safety of any third-party product or service. If you encounter an issue with a third-party Reward, you may contact us at info@movemore.ca, and we may, at our sole discretion, restore the Points you spent.
Expiration: Points will expire and be forfeited if your account is terminated or deactivated for any reason.

5. Prohibited Conduct

You agree not to:

Use any automated means, including bots, scripts, or physical devices, to simulate motion, complete challenges, or accumulate Points.
Create more than one account for personal use.
Use the Services for any illegal or unauthorized purpose.
Attempt to reverse-engineer, decompile, or otherwise access the source code of the app.

6. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will immediately cease, and all accumulated Points in your account will be forfeited.

7. Intellectual Property

All content, branding, logos, and technology associated with the Services are the exclusive property of MoveMore Inc. and its licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available," without any warranties of any kind, express or implied. We do not guarantee that the Services will be accurate, reliable, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, MoveMore Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Venue: You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the provincial or federal courts located in Toronto, Ontario, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts.
Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY PROCEEDING TO RESOLVE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

11. Changes to These Terms

We may modify these Terms at any time. We will provide notice of changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
